1. INTRODUCTION
LOGIC FUSION LLC, a company organized under the laws of the State of Florida, with its registered office at 4713 Southern Breeze Dr, Naples, Florida 34114, USA (“we,” “us,” or “our”), is committed to protecting your privacy. This Privacy Policy (“Policy”) describes how we collect, use, disclose, and otherwise process personal data when you use our services available through https://famsync.net/, its subdomains or landing pages (the “Platform”), and the FamSync: Location Sharing App for iOS mobile devices (the “App”, and together with the Platform, the “Services” or “FamSync”).

For the purposes of applicable data protection laws, including Regulation (EU) 2016/679 (the General Data Protection Regulation or GDPR), Logic Fusion LLC acts as the data controller with respect to the processing of Personal Data described in this Policy.

This Policy applies to all users of the Services (“users”) and to any individuals whose Personal Data we process in connection with the provision of the Services (“you”). 

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, or legal requirements. When we do, we will post the updated version and revise the “last updated” date. We encourage you to review this Policy periodically.

2. INFORMATION WE PROCESS
For the purposes of this Policy, “Personal Data” means any information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, to an identified or identifiable natural person.


2.1. Information You Provide
When you use FamSync, you may provide certain Personal Data necessary to access and use the Services:
  • Account Information
Email address, phone number, and password or passcode used to create and secure your account. We also collect your birth date to verify your age.

  • Location Data (Opt-In Only)
We collect and process precise, real-time location data only when you enable location sharing through device-level and in-app settings. Location data is processed solely to provide the core geolocation features of the Services and is not collected by default. You may disable location sharing at any time.

  • Third-Party Login Information
If you choose to sign in using a third-party authentication service (such as a social media), we may receive limited profile information permitted by that service, such as your name, email address, and profile image.

  • User Communications and Interactions
Information you voluntarily provide when contacting customer support, participating in surveys or promotions, or interacting with us through social media or other communication channels.

  • Recipient Contact Information (Location Sharing Requests)
To invite someone to share their location with you, you may need to enter their phone number. We use this information only to send the invitation and enable location sharing. 

Important: Location sharing works only when each person opts in. We do not allow users to track people who have not agreed to share their location. If you invite someone, your phone number will be shown to the recipient of the invite.


2.2. Information Collected Automatically

We automatically collect certain information to help the Services function properly, remain secure, improve performance, and support our business and marketing activities. Some of this information may identify you or your device and is therefore treated as Personal Data and protected accordingly.

The information we may collect includes:
  • Device information, such as device type, operating system, OS version, device model, and manufacturer.
  • Connection information, including IP address, mobile carrier, timestamps, and session duration.
  • General location information, such as country, region, city, time zone, and language settings, derived from your IP address or device settings.
  • Device and technical identifiers, such as advertising identifiers (for example, IDFA or Android Advertising ID), vendor or device identifiers (such as IDFV), internal user identifiers (UUID), attribution identifiers (such as AppsFlyer ID), and similar technical identifiers.
  • App information, including the App version, configuration, and technical properties necessary to operate and analyze the App.
  • Usage and log data, such as when you access the App, how long you use it, and how you interact with features and screens.
  • In-app events, including actions such as completing onboarding steps, starting trials, subscribing, making purchases, and other interactions, together with related timestamps and transaction identifiers.
We do not combine advertising or attribution data with precise location data.

Precise Location Data (Opt-In Only)
Precise, real-time location data is considered sensitive personal data.
When location sharing is enabled on your device or browser, we may collect:
  • Precise, real-time location data from your device;
  • Location updates while the App is in use (foreground) and, if you allow it, while the app is running in the background.
We use precise location data only to provide FamSync’s core location-sharing features, and never – for advertising or targeted marketing purposes.

Data additionally collected on the Platform
a. Cookies & Tracking Technologies
When you use the FamSync Platform, we may use cookies and similar technologies to:
  • Enable basic website functionality;
  • Remember preferences;
  • Analyze usage patterns;
  • Support marketing and promotional activities, such as understanding how visitors find and use our Platform.

b. Logs and Analytics 
When you access our Platform, we collect technical logs and analytics data, including:
  • Server logs, such as IP address, browser type, operating system, and session data;
  • Internal identifiers, used to operate and secure the Service;
  • Analytics data, collected in aggregated or pseudonymized form, to understand usage trends, improve the Service, and evaluate the effectiveness of our marketing efforts. We may use third-party analytics tools (such as Google Analytics) configured to limit data collection where possible and to comply with applicable privacy requirements. 2.3. Information We Receive from Third Parties

Advertising and Analytics Partners
We work with advertising, analytics, and attribution partners to understand how users discover the Services and to measure campaign performance. From these partners, we may receive limited, pseudonymous data, such as campaign or conversion information and aggregated usage or performance events.

We do not receive information that directly identifies you, such as your name or contact details, and we do not obtain or combine precise location data through advertising or attribution technologies. Where required by law, this processing is based on your consent; otherwise, it is carried out based on our legitimate interests in measuring and improving the Services.

Apple App Store Data
When you download the App or purchase subscriptions through the Apple App Store, we may receive limited information, such as subscription status, receipts, and related identifiers. App store providers process this data under their own privacy policies and act as independent controllers. We do not receive your full payment card details.


2.4. How We Collect Data in Different Web Scenarios

We collect different types of information depending on how you interact with the Platform and at what stage of the user journey you are. Below we explain what data we collect, when, and why.

a. Visiting Landing Pages and Pre-Sign-Up Interactions
When you browse our landing pages, quizzes, or other publicly accessible parts of the Platform, we may collect limited technical information to make the website work properly, understand interest in the Service, and support user acquisition activities.
  • Cookies and similar technologies, used to enable core website functionality, measure traffic, and understand how visitors interact with the Platform. Where required by law, cookies are used only after you are informed through a cookie notice or consent mechanism. 
  • Data Shared Before Subscription. You may choose to provide your email address and phone number in order to try the Service. If you do so, we collect the contact details you provide, along with certain technical identifiers, timestamps, and usage logs. We process this data based on your consent and/or on our legitimate interests to demonstrate and offer the Service to you, prevent misuse, and ensure proper operation. Such data is typically retained only for as long as necessary for these purposes. 

b. Data Collected After Subscription 
When you subscribe to the Service and become a user of the Platform, we collect and process Personal Data as necessary to provide the purchased Services and to support our efforts to operate, maintain, improve, and market FamSync. Depending on how you use the Services, this data may include:
  • Account information, such as email address, password, phone number, and date of birth or age (used only to verify eligibility to use the Service);
  • Location information, including approximate location derived from IP address and precise location data, collected only when you explicitly enable location sharing;
  • Technical identifiers, such as internal user IDs, authentication identifiers, and advertising or marketing identifiers where applicable;
  • Activity and status logs, such as subscription status, feature usage, timestamps, and consent records.
3. THE LEGAL BASES AND PURPOSES OF PROCESSING
We use Personal Data only when the law allows us to and only for clear, specific reasons. For this, we rely on the following legal grounds:

  • To provide the service (Contract)
We use Personal Data when it’s needed to create your account, manage your subscription, and deliver FamSync’s features.

  • With your permission (Consent)
We use Personal Data when you clearly agree to it — for example, when you turn on precise location sharing.

  • For our legitimate business needs (Legitimate Interests)
We use some data to run and improve FamSync, keep it secure, understand how it’s used, and promote the service — but only when this does not unfairly impact your privacy rights.

  • To follow the law (Legal Obligations)
Sometimes we must use or share Personal Data to meet legal, regulatory, or lawful government requirements.
We may use your Personal Data for the following purposes and under the applicable legal basis:

Purpose: Provide and operate the Services
What Data We Use: account information (email, phone number), birth date, authentication data, device identifiers, basic usage data, connection data (IP and approximate location).
How We Use It: to create and manage your account, authenticate users, enable core features, and ensure the Services work as expected.
Legal Basis: Contract.

Purpose: Precise location sharing (opt-in only)
What Data We Use: precise, real-time location data and location updates (foreground and background, where enabled).
How We Use It: to enable location features of FamSync; location sharing is off by default and can be turned off at any time. Never used for any other purposes.
Legal Basis: Consent.

Purpose: Manage accounts and provide customer support
What Data We Use: contact details, account data, communications with support.
How We Use It: to respond to requests, resolve issues, provide assistance, and manage your account.
Legal Basis: Contract, Legitimate Interests.

Purpose: Manage subscriptions and verify payments
What Data We Use: Limited billing information (payment method type, card brand, last four digits, transaction identifiers, subscription status), technical identifiers and logs, subscription status
How We Use It: To confirm subscription status, process refunds where applicable, and respond to billing inquiries

Purpose: Improve and develop the Services
What Data We Use: Usage data, feature interaction data, device and app information, performance and crash data
How We Use It: To understand how the Services are used, fix bugs, improve functionality, and develop new features

How We Use It: To display ads about the Services on third-party platforms (such as Meta, Google, TikTok); to track advertising interactions, create audience segments, and deliver targeted advertising where permitted.

Purpose: Advertising measurement and attribution
What Data We Use: Advertising identifiers (where enabled), internal user ID (UUID), IP address, device and app information (such as device identifiers, OS, and app version), install, subscription, transaction, and other in-app event data (including timestamps).
How We Use It: To understand how users discover the App, measure campaign performance, attribute installs or purchases to specific ads, and detect invalid or fraudulent traffic.
Legal Basis: Consent (where required); Legitimate Interests

Purpose: Campaign optimization and marketing analysis
What Data We Use: Advertising identifiers (where enabled), internal user ID (UUID), IP address, device and app information (such as device identifiers, OS, and app version), install, subscription, transaction, and other in-app event data (including timestamps).
How We Use It: To analyse post-install behavior, improve campaign targeting, optimise marketing budgets, and generate aggregated audience insights. We do not use your name, email address, or precise location data for these purposes.

Note: Processing for campaign attribution and related marketing purposes may involve profiling based on your interactions with the Services in order to measure performance and improve advertising targeting. We do not use this data to identify you by name, and this activity is not intended to make decisions that may produce legal or similarly significant effects on you.

We do not use precise location data for advertising, user acquisition, or campaign targeting.
4. SHARING OF YOUR INFORMATION
We do not sell your Personal Data. We do not allow third parties to use your Personal Data for their own independent marketing purposes, and we do not share Personal Data except as permitted under this Privacy Policy and applicable law.

We will specifically inform you and obtain consent if we ever need to share your Personal Data for a new purpose not covered by this Policy.


4.1. Disclosures Made by You. FamSync Rooms 

As a geolocation service, FamSync shares precise location data only as a result of your explicit actions within the App. Precise location data is never shared automatically and is disclosed only when the data subject has chosen to enable location sharing. Location sharing can be disabled at any time through the App or device settings.

If you create or join a FamSync Room (for example, a family or trusted group), certain information is shared with other members of that Room as part of the Service’s core functionality. This may include your name or profile information, real-time location (when sharing is enabled), alerts, and messages or updates exchanged within the Room.

Location sharing in a Room occurs only when enabled by the user and can be turned off at any time. You control who can join your Rooms and may leave a Room whenever you choose. Sharing within Rooms is fundamental to how FamSync works and is designed to help connected users stay informed and coordinated.


4.2. Service Providers

We engage trusted third-party service providers (“processors”) to help us operate the Services. These processors process Personal Data only on our behalf, only under our instructions, and only for the purposes described below.

Our service providers are not allowed to use your Personal Data, including location data, for their own purposes. Where required by law, we enter into data processing agreements with our processors and remain responsible for their processing activities.

How to opt-out from tracking in the App
You can control how your data is used for analytics and advertising at any time through your device settings. 

iOS 
If you use the App on an iOS device, you can limit or disable app tracking as follows:
  • Open Settings → Privacy & Security → Tracking.
  • Turn off “Allow Apps to Request to Track”, or manage tracking permissions for individual apps.
  • You can also reset or limit the use of your advertising identifier (IDFA) in your device settings.
If you do not allow tracking, the App will not access your advertising identifier for advertising or marketing purposes.

Your choices apply across apps and affect how advertising identifiers are used.

Changes to your device settings apply going forward and may not affect data already collected. Some features of the App may still rely on limited analytics or technical data needed to operate properly.

Important Note: Limiting tracking in the App reduces personalized advertising based on our data. However, platforms may still show you ads based on information they collect independently, such as your activity on their services or your approximate location.


4.3. Personnel

We may provide access to Personal Data to our employees, contractors, agents, and auditors who need such access to perform their professional duties. All such persons are bound by written confidentiality and data-protection obligations consistent with this Privacy Policy.


4.4. Legal Requirements, Business Transfers, and Protection of Rights

We may disclose Personal Data where necessary to comply with applicable laws, regulations, subpoenas, court orders, or other valid legal processes, including lawful requests from public or law-enforcement authorities. We assess such requests carefully and disclose data only to the extent legally required.

We may also disclose Personal Data where we believe in good faith that such disclosure is necessary to protect our rights, protect the safety of users or others, investigate fraud or misuse, or enforce our agreements and policies.

If we are involved in a merger, acquisition, reorganization, or sale of all or part of our business or assets, Personal Data may be transferred as part of that transaction. In such cases, we will provide notice through the Platform of any material change and inform you of available choices.

Depending on the circumstances, we rely on legal obligations or legitimate interests as the legal basis for such disclosures.
5. YOUR PRIVACY RIGHTS
We are committed to respecting and honoring valid requests regarding your Personal Data regardless of where you live, even if your local laws are not specifically listed in this section. Where reasonably possible and legally permitted, we apply the same privacy rights and safeguards worldwide, consistent with applicable data protection principles and our technical capabilities.


5.1. Rights Under the GDPR and Equivalent Laws

If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, you have the following rights under the GDPR or equivalent laws:
  • Right of Access – to obtain confirmation of whether we process your Personal Data and access to that data;
  • Right to Rectification – to request correction of inaccurate or incomplete Personal Data;
  • Right to Erasure – to request deletion of your Personal Data, subject to legal obligations;
  • Right to Restrict Processing – to request limitation of how we use your Personal Data;
  • Right to Data Portability – to receive your Personal Data in a structured, commonly used, and machine-readable format;
  • Right to Object – to object to processing based on our legitimate interests, including processing for marketing purposes;
  • Right to Withdraw Consent – where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of processing before withdrawal.
You also have the right to lodge a complaint with your local data protection authority.


5.2. Rights Under U.S. State Privacy Laws

California (CCPA / CPRA)
If you are a California resident, you have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:
  • Right to Know / Access. You have the right to request information about the categories of Personal Data we have collected about you, the sources of that data, the purposes for which it was collected, and whether it was disclosed for a business purpose in the preceding twelve (12) months.
  • Right to Delete. You may request that we delete Personal Data we have collected from you, subject to certain legal exceptions.
  • Right to Correct. You may request that we correct inaccurate Personal Data.
  • Right to Opt Out of Sale or Sharing. We do not sell your Personal Data and we do not, unless you explicitly allow us, share it for cross-context behavioral advertising to the extent this term is defined under applicable law.
  • Non-Discrimination. You have the right not to receive discriminatory treatment for exercising your privacy rights.
  • Authorized Agents. You may designate an authorized agent to submit a request on your behalf. We may require proof that the agent is authorized to act for you.
We do not have actual knowledge that we sell or share the Personal Data of minors under 16 years of age.

Virginia (VCDPA)
If you are a Virginia resident, you have the right to:
  • Confirm whether we are processing your Personal Data;
  • Access your Personal Data;
  • Delete Personal Data you have provided to us;
  • Correct inaccuracies in your Personal Data;
  • Opt out of the processing of Personal Data for targeted advertising, sale of Personal Data, or profiling in furtherance of decisions that produce legal or similarly significant effects.
Please note that we do not sell Personal Data and do not engage in profiling that produces legal or similarly significant effects.

5.3. How to Exercise Your Rights

To help us process your request efficiently, please clearly describe your request and include sufficient information for us to verify your identity.

We may request additional information to verify your identity or authority to act on behalf of another person. We will respond to your request within the timeframes required by applicable law.

Please note that we can only fulfill requests with respect to Personal Data that we control or can reasonably access. Certain data may be retained as required by law or for legitimate business purposes.
6. INTERNATIONAL TRANSFERS OF PERSONAL DATA
FamSync operates globally. To provide the Services, your Personal Data may be processed, stored, or accessed in countries other than your country of residence, including in the United States and other jurisdictions where we or our service providers operate. These countries may have data protection laws that differ from those in your jurisdiction.

When we transfer Personal Data internationally, we take appropriate measures to ensure that your data remains protected in accordance with applicable data protection laws. These measures may include relying on recognized legal transfer mechanisms, such as standard contractual clauses approved by relevant authorities, and working only with service providers that implement appropriate technical and organizational safeguards.

We transfer Personal Data internationally only for the purposes described in this Privacy Policy and only to authorized recipients. We do not transfer Personal Data for purposes that are incompatible with those purposes, and we do not permit recipients to use your data for their own independent purposes.
7. RETENTION
We generally retain your Personal Data for as long as is necessary for performing the functional service of the Platform and to comply with our legal obligations. If you no longer want us to use your Personal Data that we physically access and store, you can request that we erase your Personal Data and close your account. 

Account Creation & Deletion: Your account is automatically created upon providing an email and completing a subscription payment. You can delete your account via settings, though some data may be retained as required by law. When you delete your account, we delete or de-identify your Personal Data within a reasonable time, unless we need to keep certain information for legal, tax, fraud-prevention, or security purposes. For example, transaction records and basic audit logs may be retained for compliance and dispute handling.
8. SECURITY
We take reasonable steps to protect your Personal Data and use technical and organizational measures designed to keep it secure. These measures help protect your information against unauthorized access, loss, misuse, alteration, or disclosure during transmission and storage.

Where appropriate, we use safeguards such as encryption, hashing, access controls, and system monitoring to protect Personal Data. Access to your information is limited to authorized personnel and service providers who need it to perform their work and who are subject to confidentiality and security obligations.

No system can be guaranteed to be completely secure. While we work to protect your Personal Data, we cannot promise absolute security. If a security incident occurs, we will take reasonable steps to investigate and address it and will notify affected users and authorities when required by law.

Important note: Our App is available for download only through the official Apple App Store. If you obtain the App from any other source, we cannot guarantee its security, availability, or proper functioning. Accessing or using the App through unauthorized sources is considered improper use and may result in suspension or termination of access to the Services.

9. CHILDREN'S PRIVACY
FamSync is designed to help trusted people, including family members, share their location. The Services are not intended to be used independently by children.

As a general rule, users must be at least 13 years old to use FamSync. If you are located in the EEA/UK, users must be at least 16 years old (or a lower age where permitted by applicable local law) to use the Services without the involvement of a parent or legal guardian.

We do not knowingly collect Personal Data directly from children below the applicable age without appropriate parental or guardian involvement. If we become aware that Personal Data has been collected from a child without the required consent, we will take steps to delete that information as required by law.
